2. How the contract is made between us
a) Please read through carefully the order form before you sign
b) Once we send you a confirmation of order, then the contract between us will be made
c) Some of our Services give you the option to upgrade or downgrade to a different service level. If you want to upgrade or downgrade any Service that you have bought from us we will try to make your upgrade or downgrade effective as soon as possible, but you agree that this may not happen until the start of a future Month.
Please note that we do not offer upgrades and downgrades for all of our Services
3. Length of contract
a) The agreement will begin from the day that we send you the confirmation of order.
b) if there is a minimum service contract that will be indicated to you by the Marketing Executive and in the confirmation order.
c) the agreement will otherwise continue on a monthly rolling contract and will only be cancelled by either us or you
d) Once the minimum service contract has been completed then the service will then continue on a monthly rolling contract and will only be cancelled by either us or you.
a) In return for the Fees, we will provide you with access to and use of the Services that you have bought.
b) You agree that we may change how Your Content looks or is formatted if we think this is necessary to improve the overall performance of the product.
c) Some of our Services rely on third parties, for example Google or Facebook, to do certain things. You acknowledge that (i) we may not be able to provide a particular Service feature where you do not meet criteria set down by a relevant third party; (ii) we do not have any control or exercise influence over the third party’s own services; and (iii) a third party’s service may stop or change from time to time. You acknowledge that these are Events Outside Our Control and that we not to be held responsible for any impact these events may have.
d) Some of our Services give you the option to use third party products/services, for example Google Maps. You agree that this use is subject to the terms and conditions of those third parties and that we are not responsible for the performance or non-performance of any third party tools.
e) Some of our Services involve us acting on your behalf as your agent, for example, to repoint or move your own Domain Name from one hosting provider to another. You acknowledge and agree that: (i) where necessary, we are authorised to act on your behalf as your agent; (ii) we are authorised to access your account on your behalf; and (iii) you remain responsible for your account with any third party providers.
f) some of our services, require your input by providing us with the relevant content or photographs, if after 24 hours we have not received this information we will design the product using our library catalogue of images, this can then be changed when the service is live
5. How to contact us
a) our customer service department is open between the hours of 9-5 Monday to Friday
b) You can contact your marketing executive directly through their mobile between the hours of 7.30am- 10.00pm Monday to Friday
c) alternatively, you can contact us via email, post or you can drop into the office between the hours of 9-5 Monday to Friday
d) If we need to contact you we will do so via telephone, email or post
6. Changes to the service
a) This may be for a number of reasons, for example where changes are necessary because of a change in Laws or to keep up with changes in technology, or where things happen that make it unwise or difficult to continue to provide a Service in its current form. In the unlikely event that we think that the change is likely to have a serious negative effect on you or your business we will tell you about the change either by email or telephone
7. Pricing and monthly management fees
a) For all services we will charge you either a one off build fee and/or monthly management fee, for example our website service requires a one off build fee and a monthly management fee.
b) The one off build fee is taken on initial consultation with the marketing executive
c) The monthly management fee is taken by standing order, you will be required to complete and sign the standing order mandate before the programme is live
d) the first monthly management fee is taken one month after signing the order form
e) If you don’t pay on the agreed day, then we will contact you via telephone and request over the phone card payment, if this is unsuccessful we reserve the right to suspend and terminate the service, however this is our last resort.
f) the one off build fee is non- refundable
8. Guarantee of performance
a) we do not guarantee the success of your marketing programme and we do not refund money due to lack of performance.
b) if you have any issues with any of our products and services then please either contact your Marketing Executive or our customer service team.
On production of the first draft of your website the build fee paid at point of sale becomes non refundable. The Digital Hut will have then produced the goods for the payment recieved and forfilled our obligation to the customer.
